Extreme Spearfishing Pty Ltd offers this website, including all information available to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. Please read these Terms of Service carefully before placing an order with us. By purchasing product from Extreme Spearfishing Pty Ltd, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access our services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. By purchasing something from us, you engage in our “Service” and agree to be bound by these terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein. These Terms of Service apply to all users of the website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

The material on this site and or website is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site and or website may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site. All MSRP pricing contained within this website is GST inclusive. Prices of our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. 

SECTION 3 – FREIGHT (INTERNATIONAL)

No international freight. To support our consumers with the best level of after sales support, all products purchased on this website will not be shipped to locations outside of Australia. 

SECTION 4 – GENERAL TERMS AND CONDITIONS PRODUCT WARRANTY

Except for those required or implied by legislation, Extreme Spearfishing Pty Ltd gives no express warranty in relation to products and services supplied to the Customer, and the Customer acknowledges that it has not relied on any representation or warranty made by or on behalf of Extreme Spearfishing Pty Ltd. Certain legislation may imply conditions and warranties into these terms and conditions. To the extent that such conditions and warranties may lawfully be excluded, all such conditions and warranties are expressly excluded. The liability of Extreme Spearfishing Pty Ltd under or arising out of the supply of goods and services for breach of any term, condition or warranty implied in or imposed upon the supply of goods and/or services by legislation, shall be limited, at the option or Extreme Spearfishing Pty Ltd to:

(a) the replacement of the goods or the supply of equivalent goods;

(b) the repair of the goods;

(c) the payment of the cost of replacing the goods or of acquiring equivalent goods; or

(d) the payment of the cost of having the goods repaired.


Except to the extent the law provides that liability is not able to be excluded, Extreme Spearfishing Pty Ltd shall not be under any liability to the Customer in respect of any loss or damage (including consequential or indirect loss or damage or loss of profits, loss of use or loss of data) however caused, which may be suffered or incurred or which may arise directly or indirectly in respect of the Products, any services supplied by Extreme Spearfishing Pty Ltd or the failure of Extreme Spearfishing Pty Ltd to comply with these terms and conditions. 

SECTION 5 – 30-DAY SATISFACTION GUARANTEE

If at any time during the first 30 days of purchase of retail goods from Extreme Spearfishing Pty Ltd, where that product fails to meet the Customers performance criteria, that product may be exchanged for a similar or like product of equal or lesser value. Any increase in replacement product value must be borne by the customer. Specifically produced products, e.g. custom or tailor-made products are excluded from this program. Exclusive clearance items listed as not for return are excluded from this program. 

SECTION 6 – WARRANTY PERIOD

All products unless listed as excluded from warranty, when purchased from Extreme Spearfishing Pty Ltd, under normal recreational use, are provided with a one (1) year Warranty to cover against defects in materials, workmanship and performance to product specifications. Exceptions – Punctures, rips, tears, normal wear, zip slider dislodging zipper teeth. 

SECTION 7 – WARRANTY CONDITIONS

Warranty coverage for the above-mentioned products will only apply to products accompanied by proof of purchase.

  1. The product must only be used as intended for normal recreational purposes.
  2. The product warranty does not cover loss, or damage due to accident, abuse, tampering, lack of maintenance, exposure to excessive temperature, extended sunlight or deteriorating chemicals.
  3. This warranty shall be void if the equipment has been tampered with by a person (or persons) not authorised by Extreme Spearfishing Pty Ltd to perform such service.
  4. Normal wear and tear as determined by age and usage is excluded from the 1-year Warranty.
  5. To maintain this one-year Warranty, you must show proof of purchase. If returned for service, your product should be accompanied by a copy of the original sales receipt.

SECTION 8 – HOW TO CLAIM FOR WARRANTY

If a warranty claim is necessary, the best option is to contact us through our contact us page. An Extreme Spearfishing Pty Ltd representative will guide you through the return process. 

SECTION 9 – WHAT COSTS ARE INVOLVED FOR A WARRANTY CLAIM

Extreme Spearfishing Pty Ltd warrants that it will fix, repair or replace any defective product described above at no cost to the consumer. After service, the product will then be returned to the

SECTION 10 – GOODS RETURN POLICY

Any goods forwarded for service or repair or otherwise must be done so at the consumers expense. Extreme Spearfishing Pty Ltd will not be liable for

freight costs incurred in the return of any product. 

SECTION 11 – TITLE AND SECURITY INTEREST

Although you will assume the risk in the goods when you take possession, until you pay for them: we will retain ownership and title.

There may be information in this Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.


In no case shall Extreme Spearfishing Pty Ltd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Extreme Spearfishing Pty Ltd and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.


If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Australia.

You must pay any reasonable expenses (including legal fees) we incur to enforce our rights under this Agreement.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website, www.spearfishingaustralia.com. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Easy Returns Policy and Conditions 

We care about your satisfaction at Extreme Spearfishing Pty Ltd, (Extreme Spearfishing). If you are dissatisfied with your purchase for any reason, you may return it to Extreme Spearfishing within 30 days of the purchase date, subject to the conditions and exclusions below: 

Eligibility Conditions 

Please read conditions below. If all conditions are not met, Extreme Spearfishing reserves the right to refuse the return or to charge a minimum 15% restocking fee.

  • All returned items must be in new condition, in their original unaltered box (including an intact PLU code) and must include all packing material, blank warranty cards, manuals and accessories. We can only refund or exchange products provided they haven't been used in the water and are undamaged and re-merchandisable.
  • Extreme Spearfishing is not responsible for mis-handling of products or ill-treatment of goods.
  • Extreme Spearfishing is not responsible for personal data or items left in returned merchandise.
  • Extreme Spearfishing is not responsible for any consequential or incidental damage resulting from the use of any merchandise bought from us including lost or stolen equipment.
  • Claims for missing items or items damaged in transit must be received within 7 business days of receipt of merchandise.
  • If returning a wetsuit for warranty assessment, please ensure the wetsuit is thoroughly dry inside and out, otherwise there will be a delay in processing your return for hygiene reasons.

Final Sale & Non-returnable Items 

  • Purchases via our Clearance Sale promotions or otherwise listed as no-returnable item, cannot be exchanged or refunded.
  • Clearance product from our monthly “Timed Sales” are eligible for return or refund. Exchange as long as stock is available of same item.
  • Special order merchandise or any item indicated on the website as non-returnable is as such. Defective items may be repaired, exchanged or refunded at our discretion for the same model or manufacturer's equivalent model. 

Returns & Exchanges 

Securely pack all items that you would like to be returned and post mark via registered mail with tracking info as we are not liable for shipments which may go missing during transit. Please include the following with your package:

  • Return must be accompanied with the original receipt or invoice or a copy.
  • Detailed note as to the reasons of the return.
  • Instructions as to whether you would like a refund or an exchange.
  • All items must be returned in original/unused condition and in accordance with this Returns Policy specifications.
  • Unless an item is defective, if you would like an exchange, our standard freight charges apply, unless you provide a post parcel with your return.


Please allow 7-14 business days for mail-in exchanges to be processed.

Refunds & Credits

Once we receive and inspect your item(s), we will credit your account. Please allow up to 30 days for a credit to appear on your account from received date. In most cases, we will issue your refund in the same way you made the original purchase.


Purchases made via gift voucher will be refunded as a new gift voucher, they cannot be refunded as cash.

Delivery and Shipping Policy 

Shipping Terms 

We pride ourselves on fantastic customer service and our delivery & shipping service is no exception. We like to keep things as simple as possible however shipping rates are modified by a few simple location and length specifications. The fees are either $14.95 Standard Express satchel or parcel. (See below for more details).


$24.95 Courier Express parcels exceeding 75cm length or 5kg net volume. (See below for more details).


$45.00 Express Long parcels delivered to most Country and Regional areas outside of NSW. (See below for more details).


$14.95: Express satchel or parcel for most items that can be packed into satchel or parcel not longer than 45cm x 30cm 1 - 4 days of the dispatch date, allow additional time for remote country and regional areas. Packing and dispatch same day for orders received before 11am in most cases but please allow up to 2 days for dispatch in some cases. Tracking details will be provided so that you can track the progress of your order in transit to your shipping address.


$24.95: Express satchel or parcels for items that can be packed into satchel or parcel no longer than 52cm x 43cm. For eg: a 2-piece spearfishing wetsuit plus accessories). Packing and dispatch same day for orders received before 11am in most cases but please allow up to 2 days for dispatch in some cases. You'll receive tracking details so you can follow the progress of your order in transit to your shipping address.


$24.95 – Courier Cities and CBD: Items delivered to major cities and CBD areas including Perth and Darwin, and most regional areas of NSW that are Extra-Long; parcels exceeding 55cm in length, eg: Long Fins, Spear shafts, spearguns, Polespears, are covered by our subsidised shipping service at a flat rate of $19.95. Expect 1-3 days delivery time, and an additional 2 days to Perth and Darwin. You'll receive tracking details so you can follow the progress of your order in transit to you.


Very Remote Area Surcharge : Shipping to certain remote areas incurs an additional surcharge. Extreme Spearfishing reserves the right to alter quoted shipping rates from our website in these unique cases. No automatic charges are applied, you will be contacted and your complete confirmation is required before we can proceed with the final payment and shipping of goods.

Offshore islands and territories may incur additional delivery charges, in which case our customer service team will contact you. Large or bulky orders may be shipped by road and may take additional time to deliver.

    Please note that size charts do differ from one brand to the next at times so we do strive to provide the best information in the product descriptions to inform you and allow you to make the correct decision. If your item doesn’t fit however, don’t worry we offer a 30 day Returns Policy so you can simply return and exchange for the right size. Please read the returns policy details to ensure your product is eligible for

    return. 


  • 3. When will my order be delivered?

    We will provide you with a link to your parcel tracking information that will allow you to track the progress of your order and the delivery once in transit. Once your order has been received we aim to dispatch for delivery within 0-2 business days (excluding weekends) and next day delivery is typical to all major cities within Australia on the East Coast with 1-2days extension for the West Coast. We are unable to simply state an accurate delivery time estimation here as it will vary depending on whether you live in a major city or in a remote location. Deliveries to offshore territories and very remote regions can take up to several weeks to arrive. For delivery within Australia, we use Australia Post or Couriers Please or StarTrack. Deliveries cannot be made on public holidays.

  • 5. Will I get charged duties or taxes?

    Within Australia, all prices and sale or clearance prices shown are inclusive of Australian GST. No further duties or taxes apply. Please note we do not ship internationally. 


  • 6. Where do you deliver to?

  • 7. I ordered some items on the weekend, when will I receive them?

    Our dispatch team operate from Monday to Friday and therefore any orders from the weekend will be shipped as soon as possible on our return to work the following Monday depending on volume of orders. 


  • 8. I would like to cancel my order?

    If your order has not been processed by our team then we are able to cancel the order however, please make sure you call us as soon as possible on (02) 9907 491 and quote your order reference number. Unfortunately if your order has already processed and shipped then we will be unable to cancel it however, we do offer a 30 day returns policy.

  • 9. My delivery address has changed?

    Not a problem, as long as your items haven’t been shipped then we can easily change your details on our systems. Please call us as soon as possible, quoting your order reference on (02) 9907 4911. 


  • 10. How do I get my order shipped ASAP?

    Place your order the night before, and if it is an extreme rush, don’t hesitate to call us in the morning business hours to let us know the urgency. We will let you know if we can get it out that same morning you called or at least same day.

    Unfortunately we are unable to offer same day delivery. 


  • 12. What payment methods do you accept?

    You can pay by either PayPal, Credit Card via Swipe secure payment system or After Pay at the online checkout.

    When purchasing from Extreme Spearfishing your financial details are passed through a secure server using the latest 128-bit SSL (secure sockets layer) encryption technology. 128-bit SSL encryption is the industry standard.


    We also use physical and electronic security measures to ensure personal information is not misused, lost, changed or stolen. These include restrictions on physical access, secure databases or electronic firewalls. 


  • 14. Can I change my order?

    We will try our very best in order to change your order as long as your items have not been dispatched already. Please call us as soon as possible on (02) 99074911 and quote your order reference number. 


  • 15. I would like to view the status of my order?

    We understand the importance of knowing where and when you might receive your order. We will provide you with a link to the couriers 3rd party tracking page that displays the transit of your parcel all the way to your doorstep, stage by stage. Please check your emails for alerts indicating your parcel having been received by the courier. If you are unsure or want to confirm, please don’t hesitate to call us on (02) 9907 4911. 


  • 16. Can I pick up my order?

    Yes...simply select the "In-Store Pickup" option when checking out if you'd like to collect your order from store in Sydney on the Northern Beaches: 1/539 Pittwater Rd Brookvale, (Sydney), NSW 2100. Full payment is required in order to secure your items as we will not hold anything without payment being received. Items may not be ready for immediate pick up so please wait for an email to confirm your order is ready before coming down to the store or contact us first on (02) 9907 4911. 


  • Store Pickup Information

    Store Pickup lets you avoid shipping charges and pick up your order in our store at 1/539 Pittwater Rd, Brookvale NSW 2100 (Northern Beaches, Sydney).


    Here's how it works:

    -During checkout, choose Store Pickup for shipping option. 

    -Place your order and wait to receive a "Ready for pickup" e-mail or contact us via ph (02) 9907 4911.


    Bring to the store:

    - Your photo ID.

    - Your order number.

    - For purchases over $500 and or any dive wrist computers, the credit card used for the purchase must be presented at point of collection by the card holder.


    At the store:

    - We have a double car width driveway with car parking right out front and around the back of our retail store you can use.


    - Your photo ID.

    - Your order number.


    Who Can Pick Up Your Order

    You can pick up your order yourself or choose someone else to pick it up (Friends & Family Pickup). Your pickup person will need to show his/her ID and the order number at the store. For orders over $500 the buyer must collect the goods in person along with the credit card used to purchase or copy of the PayPal transaction confirmation email. 


    Product Availability

    Some items may not be immediately available for pickup from our store. Items not in stock usually arrive at the store within 3 to 7 business days. We'll send you an email when your items are ready for pickup.
